Defendant-intervenors File Opposition Brief in NAMUD No. 1 v. Gonzales

On June 15, the defendant-intervenors filed a consolidated brief in opposition to plaintiff's motion for summary judgment in North Austin Municipal Utility District No. 1 v. Gonzales, plaintiff's challenge to Section 5 of the Voting Rights Act. The defendant-intervenors' brief contends that plaintiffs are not entitled to bail out from Section 5 coverage and that Section 5 is constitutional.

On July 6, defendant-intervenors will be filing a brief in support of their motion for summary judgment. The argument on the cross-motions for summary judgment will be heard on September 17. The Lawyers' Committee and Wilmer Cutler Pickering Hale & Dorr LLP represent the NAACP; other defendant-intervenors are represented by NAACP LDF ("Louis" clients), ACLU (Nathaniel Lesane), MALDEF ("Diaz" clients), Public Citizen and Texas Riogrande Legal Aid ("Garcia" clients), PFAWF ("PFAWF"), and Renea Hicks and Gerald Hebert (Travis County).
